Data on domestic violence

Various reports and studies show that domestic violence is one of the forms of gender-based violence, which especially women and children face in our society.

The spread of this disturbing phenomenon has been accompanied by measures to protect victims of domestic violence and punish the perpetrators. According to the prosecution, for 2012-2013, offense 130 / a of the Criminal Code occupies respectively 88% and 87% of registered proceedings for group for criminal offenses against children, marriage, family in a total of 371 proceedings (2012) and 946 proceedings (2013) ). The number of proceedings has increased by 150% in 2013 (826 criminal proceedings with 791 defendants, compared to 328 proceedings with 255 defendants in 2012). There is a 255% increase in the number of persons charged in court during 2013 (589 proceedings were sent for trial and charges were filed against 606 defendants, compared to 159 proceedings sent for trial and 171 charges filed in 2012). For this criminal offense were convicted: 69 defendants (2012); 405 defendants (2013). On sexual violence, there is 1 criminal proceeding registered for sexual intercourse with violence between spouses / cohabitants (2013) [2] .. ”

According to Amnesty International Report 2015/2016, regarding violence against women and girls, the State Police reported 1,696 cases of domestic violence in the first six months of 2015, requesting 993 requests for protection orders.

Out of 406 claims filed in the capital courts between January and August 2015, only 118 orders were issued, while 251 applicants withdrew their claim, or did not attend court due to pressure from abusers or their family members. In Tirana, between January and June, defendants were convicted of domestic violence in 185 out of 190 prosecutions; most have pleaded guilty [3].

According to the data of the Ministry of Social Welfare and Youth [4], for the period January-September 2016, were reported 3195 cases of domestic violence, marking an increase compared to 2015.

According to the State Police data, for 2016, were reported 4163 cases of domestic violence and crime . Of these 3062 are women / girls harmed by violence, or 78% of no. total of reported cases. 22% are men / boys and 186 are minors. 16 cases were registered with murder, of which 11 were women / girls and 3 minors [5].

The Commissioner for Protection from Discrimination, in dealing with cases of discrimination over the years has found that the number of complaints of discrimination due to gender is mainly low. Referring to the reviewed complaints, in cases when the CPD has found discrimination, it turns out that the victims are mainly women. [6]
